Why wasn't Senator Joseph Mccarthy tried for treason for making offense to the constitution of the USA?

Communism is LEGAL in the united states, and the government isn't allowed to make any abridgement to the practice of free embly and speech as per the first amendment. so why was Mccarthy tolerated? why wasn't he locked up for treason?
